Federal Fair Housing

The Fair Housing Act prohibits discrimination by direct providers of housing, such as landlords and real estate companies, as well as other entities, such as municipalities, banks, and other lending institutions.


The seven federally protected classes under the Fair Housing Act are:

  • Race
  • Religion
  • National origin
  • Color
  • Familial status (the presence of children under the age of 18 in a household)
  • Sex
  • Disability


Federal interpretation now includes sexual orientation and gender identity as protected under the "sex" classification. The Act prohibits discrimination in all aspects of real estate transactions, including advertising, sales, rentals, financing, and the provision of real estate services.
