West Virginia Seller Disclosure Requirements

West Virginia operates under a “caveat emptor” (buyer beware) doctrine, meaning that buyers are generally responsible for conducting their own inspections and investigations.


That said, sellers are still required to disclose:

  • Known material defects
  • Issues they cannot legally conceal or misrepresent


There is no standardized, state-mandated disclosure form, but many sellers use a general Seller Residential Property Disclosure Statement to address key facts about the property.

Lead-Based Paint Disclosure Requirements

Federal law requires sellers, landlords, real estate agents, and property managers to provide specific information about known lead-based paint and lead-based paint hazards before prospective buyers sign a contract. This applies to all residential properties built before January 1, 1978.


Before contract ratification, sellers must:

  • Disclose any known information regarding potential lead-based paint hazards and available records,
  • Provide buyers with the EPA’s lead hazard information pamphlet, and
  • Include specific language in the sales contract as required by federal, state and local law.
